摘　　要：商业秘密概念的科学界定具有重要的意义,我国现有立法对商业秘密的范围的界定与Trips协议还存在差距,这不利于保护商业秘密持有人的权利,因此,我国商业秘密保护法的立法中,应拓宽现有的商业秘密的保护范围,在界定商业秘密立法的概念时采用合理的立法模式。The business secret concept science limits have the vital significance,our country existing legislation also has the disparity to the business secret scope limits and the Trips agreement,in our country business secret protection method legislation,should open up the extent of protection about the existing business secret,when we limits business secret legislation concept we should use the reasonable legislation pattern.
