从耕地资源价值论我国耕地征用补偿的完善——以福建省为例

摘　　要：从耕地资源价值的角度,对《中华人民共和国土地管理法》(2004年)(以下简称《土地管理法》)的耕地征用补偿标准、现行的耕地征用补偿标准进行研究.结果表明:《土地管理法》的补偿标准中全省最高补偿与最低补偿仅相差32714元.hm-2,未能体现区域的差异性,且该补偿标准平均仅相当于耕地资源价值的9.40%;现行补偿标准体现了区域的差异性,且比《土地管理法》的补偿标准提高了1.24-2.08倍,但与耕地的资源价值仍有巨大差距,平均仅相当于资源价值的14.46%.可见,现有的征地补偿标准偏低,忽略了耕地资源使用的时间价值、社会价值、生态价值和空间差异,并导致了诸多不良后果;应区别征地目的,扩大征地补偿范围,考虑农民的长远补偿及征地补偿的区域差异,完善有关法律制度.In this paper,the cropland expropriation compensation standards（LECS） of ＂Land Management Law＂ and the current cropland expropriation compensation standards（CLECS） were studied from the perspective of cropland value.Result showed that the variation between highest and lowest LECS in Fujian Province only 32714 Yuan per hectare.The average LECS is only equivalent to 9.40% cropland value,and cannot represent the discrepancy of different districts.The CLECS can represent the variation of different districts,and it is 1.24-2.08 times higher than LECS.Nevertheless,CLECS still cannot represent the values of cropland,because it is only equivalent to 14.46% cropland values.Therefore,the CLECS can lead to some negative consequences;because it ignores the value of cropland（including time value,social value,ecological value and spatial variation）.In order to solve this problem,it is needed to deal the discrepancy of cropland expropriation purpose,extend the range of compensation,consider the long-term compensation of farmer,realize the variation of compensation in different districts,and improve legal system of cropland expropriation compensation.
