摘　　要：紧急状态与民主、法治和人权之间都存在着冲突,而要解决冲突的紧张关系,必须建构在紧张状态制度中的宪政路径。因此,只有从民主、法治和人权方面构建应对紧急状态制度的宪政理念,才能应对各种紧急状态下可能引发的宪政危机。In the state of emergency, conflicts will take place between democracy, government by law and human rights. An adaptable route to realize constitutionalism in the state of emergency must be chosen by taking democracy, government by law and human rights into consideration so that the potential crisis of constitutionalism in state of emergency could be averted successfully.
