摘 要:由于法律规范"技术内容"强制实施模式认识的错位、标准体制改革的滞后和《标准化法》修订的延迟,造成了我国强制性标准概念的误解和性质认定的分流。运用行政权力、通过行政手段强制实施标准,引起强制性标准亦"法""非法"的性质争议;由于对标准与法、强制性国家标准与自愿性国家标准、强制性标准与技术法规的关系认识不清,引发了强制性标准一系列困境的生成。为克服困境、化解危机,应结合我国具体国情进行方案设计和路径选择,通过一系列因素的综合考量,优先确立改良式方案,并通过《标准化法》的修订加以体现。Because the mandatory implementation mode of legal rule "technical content" is misunderstood, the standard mechanism reform lags behind, and the revision of the Standardization Law of the People's Republic of China delays, the concept of China' s Mandatory Standards is misunderstood, and its characteristic is recognized divaricately. Mandatory implementation of standards by administrative power leads to the dispute that the mandatory standards is "law" or "no law". Owing to confusing the relationship between standards and laws, compulsory government standards and voluntary national standards, mandatory standards and technical regulations, the mandatory standards face many difficulties. In order to overcome difficulties and dissolve crisis, we should combine China's national conditions to design program and select path. Through considering a series of factors comprehensively, improved scheme should be established priority, and reflected by the amendment of the law.
