外伤后下肢深静脉血栓形成的法医学鉴定分析

摘　　要：目的:探讨外伤后下肢深静脉血栓形成的赔偿医学鉴定问题。方法:选择2005年1月-2010年6月受理的外伤后在住院期间发生的下肢深静脉血栓的法医学鉴定15例,对其病因、伤残评定、后续医疗费及康复费用鉴定进行回顾性分析。结果:15例均伴有颅脑、脊柱或颅脑合并上肢损伤。发病时间3天-1月。发病后均对其肢体功能造成影响,根据不同案情分别参照GB18667-2002及GB/T16180-2006标准分别评定为Ⅷ级3例、Ⅸ级7例、Ⅹ级5例,均认定不同程度的续医及康复费用。结论:外伤后下肢深静脉血栓形成的法医鉴定结论易引起当事人的争议,其赔偿医学问题是法医鉴定的难点。法医鉴定时应充分认识其特殊性,认真分析其伤病关系,综合评价肢体功能,防止漏检或误鉴。Objective：To discuss the assessment for compensation of the post-traumatic deep venous thrombosis（DVT）of lower extremity.Methods： 15 cases were chosen among from those of DVT forensic identification from Jan.2005 to June 2010,and their causes,impairment assessments,follow-up medical expenses and rehabilitation expenses were analyzed retrospectively.Results： Among all 15 cases,head injuries,spine cord injuries or brain combined upper injuries are discovered,and the onset times of DVT rang from 3 days to 1 month.All limb functions are affected after onset.According to standards GB18667-2004 or GB/T16180-2006,3 cases were assessed as Impairment Level Ⅷ,7 cases Level Ⅸ,5 cases Level Ⅹ.Continued medical and rehabilitation expenses of various degrees are also appraised.Conclusions： Forensic medical identification results of post-traumatic DVT frequently lead to the disputes between or among the concerned parties,and its compensation is a difficult part in forensic identification.The assessor shall be fully aware of their uniqueness,analyze the relationship between their injuries,and evaluate comprehensively the limb function so as to avoid diagnosis omission or incorrect identification.
