摘 要:食品安全领域私人标准的大量涌现成为国际贸易的新课题,其产生是几方合力的结果,有着特定的社会基础和自身发展规律,对国际食品贸易的负面影响大于积极影响,特别对发展中国家中小食品生产和经营者不利。私人标准在提供更高水平安全食品供给的同时,对SPS协定构成了新的挑战,而现有SPS协议框架对私人标准的规范存在无管辖权、对非政府实体没有明确界定等诸多法律困境。以何种方式对私人标准进行回应将是SPS委员会亟待解决的问题。The emergence of food safety private standards with large quanity pose a new chal- lenge to international trade system nowadays. There are typical social conditions for their existence and special way for development. They brought consumers safer food as well as play a negative role towards international trade and SPS agreement, especially put small food producers and operators in a disadvantaged situation. However there exists lots of debate on the jurisdiction of SPS towards private standards and the explaination of non-governmental entity. As the most infulential agreement which tends to balance the protection of human, animal and plants sanitation, SPS Committee actively discusses and tackles the legal dilemma.
