摘　　要：市场中介组织的蓬勃兴起并迅速壮大,形成"国家-市场中介组织-市场"新架构,成为经济法中的一种新型主体。传统民商事法、行政法难以全面调整市场中介组织及其参与的社会公共经济管理关系,经济法的调整具有必然性。市场中介组织的宗旨、功能、属性与经济法的价值取向趋同,是经济法的适格主体。市场中介组织的经济法主体地位的确立有助于形成内外和谐的经济法体系。市场中介组织接受政府主体监管并辅助、制约政府干预。市场中介组织对市场主体予以市场规制及自律管理。The rapid emergence and expansion of market medium organization leads to its status as the new fashioned subject of economic law, and thereafter the framework of CountryTMarket Medium Organization-Market has come into being. Traditional civil and commercial law and administrative law are difficult to fully adjust the market medium organization and its participation in supervisory rela- tionship of social public economy, which leads to the inevitable adjustment of economic law. Owing to the market medium organization＇s tenet, function, attribute totally corresponds to the value-chosen orientation of the economic law, and it is a qualified subject of economic law. The market medium organization＇s subject position in economic law contributes to the establishment of the harmonious eco nomic system whether internal or external. The market medium organization accepts the supervision from government departments, and it also assists and restricts government intervention. The market medium organization also regulates market actors and realizes self-regulation.
