摘　　要：从法律的制定和实施两个层面看,我国盐业垄断的法律积弊在于垄断行政化、部门化、地方化基础上的法出多门、有法不依、选择性执法和非法行政。这注定了突围我国盐业法制困境在路径选择上所必需的针对性和可行性,同时也决定了我国盐业垄断改革法治化应有的立场和思路。As far as legislation and its enforcement are concerned, the accumulated mal-prac- tice in China＇s salt-industry monopoly lies in the conflicting laws from different sources, failure to comply with laws （practicing lawlessness）, selective law enforcement and illegal administrative, which determines the necessary pertinence and feasibility in the selection of the approaches to break through the legal dilemma of the monopoly, as well as the position and thinking for the re- form of the monopoly to be legalized.
