论国际法语境下的“环境难民”

摘　　要：随着全球气候变暖以及环境的日益衰退,"环境难民"已经成为当今人类社会最严重的危机之一。从国际法的视角分析,"环境难民"并不能获得"公约难民"的资格和待遇。相应地,"环境难民"所指称的"因环境因素导致的人口被迫迁移现象"引发了国际法对该问题的多层次思考。为此,应该从理论和实践层面进一步完善国际法的建设,为解决"环境难民"提供合理的国际法路径。With global warming and environmental degradation,environmental refugee has become one of the most serious crises of human society in modern times.From the angle of International Law,environmental refugee can't attain the status and related treatment of conventional refugee.Correspondingly,the phenomenon of forced migration caused by environmental factors which environmental refugee referred to has given rise to some deep thoughts in the framework of International Law.So,we should further perfect the development of International Law on the theoretical and practical levels to provide reasonable ways in terms of International Law for the solution of the issue of environmental refugee.
