论我国空白票据制度的完善

摘　　要：空白票据是随着经济发展和信用制度的发达而产生的,并得到了世界各主要国家、地区的票据法及国际公约的认可。我国《票据法》的空白票据理论尚不成熟,尤其在实务操作中无明确法律规定,但空白票据又具有不可忽略的价值,需要在理论与实务中对其加深认识,并借鉴国外票据法关于空白票据的规定,完善我国的空白票据制度。Blank bill,which comes into being with the development of economy and the credit system,has been approved of its validity by international treaties and the billing laws of the main countries in the world.However,the theory concerning blank bill in China is far from satisfied,and it is particularly weak in practical operation.Since the blank bill law is of undeniable value,people should deepen their understanding of it theoretically as well as practically.To attain the goal,this paper puts forward some suggestions on the perfection of the blank bill legislative system from the perspective of professional concepts and characteristics.In addition,the paper pays special attention to address the problem of restrictions in China＇s blank bill legislation with reference to the regulations concerned in some other countries.
