摘 要:新中国成立后,中国非政府组织立法从单纯的行政法规发展到宪法、法律、法规、规章等多层级立法体系,从单纯的社会团体规范发展到社会团体、民办非企业单位和基金会规范等多类型规范,从单纯的非政府组织登记管理和日常管理发展到非政府组织登记管理、日常管理、税收管理、内部治理、社会监督等多维度管理,从单纯的监督管理发展到培育发展和监督管理并重的机制。但同时也存在诸多问题。其中既有立法理念上的,也有立法框架和技术上的。因此,有必要在树立非计划思维的理念以及权利本位理念的前提下,在完善管理法的基础上,实现上下位法的配套衔接,加强非政府组织激励立法,优化非政府组织监督管理立法结构。After the founding of New China, Chinese social organizations legislation has developed from a simpie administrative regulations to other multi-level legislative system of Constitution, laws, regulations, rules and regulations, from the simple social group regulations to social organizations, private non-enterprise units and foun-dation regulations and many other types of regulations, from simple registration and daily management of social organizations to the social organization registration and management, daily management, tax management, internal governance, social supervision and other multi-dimensional management, from the simple supervision and management to an equal emphasis on cultivation and development and supervision and management mechanism. However, there are still many problems in the 60 years of legislation. These problems not only include legislative concept matters but also the legislative framework and technical problems. Therefore, it is necessary to establish non-planning thinking and right-based concept. On this premise, we can achieve the convergence of upper and lower level systems based on improving management method, and strengthen the incentive legislation of social organizations and optimize the legislative supervision and management of social organizations.
