摘　　要：目的:指出现有中药专利保护的缺陷,对我国的中药专利保护的改进提出建议。方法:基于中医药理论原理,分析我国现有中药专利保护现状。结果与结论:应借鉴现代专利制度,以中医药理论为基础,建立我国特有的中药专利保护体系。OBJECTIVE：To analyze the defect of patent protection for traditional Chinese medicine,and to make recommendations for the improvement of patent protection for traditional Chinese medicine.METHODS：Based on the theory of traditional Chinese medicine,current condition of patent protection for traditional Chinese medicine was analyzed.RESULTSCONCLUSION：Learning from the modern patent system,China-specific patent protection system has been established on the basis of the theory of traditional Chinese medicine.
