摘　　要：禁婚亲的立法价值取向应在社会利益与个人利益间寻求到最佳的平衡点。禁婚亲主体范围在遵循该立法取向上应适当放宽限制,在符合特定条件下赋予拟制的旁系血亲间、表兄妹间及直系姻亲间结婚自主权。对违反禁婚亲的法律后果,应在无效婚姻制度中补充相应的救济制度。Legislative value orientation of relatives of forbidding marriage ought to pursue the optimal balance point between social interests and personal interests. According to the value orientation, the subject scope of relatives of forbidding marriage should be extended the limitation properly. The legislation should grant the fight of marriage between fiction collateral relatives by blood, cousins and lineal affinity in special conditions. As for the legal consequence of violating relatives of forbidding marriage, we should supplement the relief system in the system of void marriage accordingly.
