我国农林植物新品种保护现状与展望

摘　　要：从品种权法律法规建立、新品种保护体系的构建、保护名录的扩大和测试指南的研制等方面总结我国农林植物新品种保护的进展,得出品种保护意识淡薄、申请数量和种属分布不均衡,以及假冒侵权严重且维权困难等方面问题突出的结论,提出我国植物新品种保护事业应适应国际趋势,加强立法、行政保护与司法保护的有效统一协调,适时加入UPOV公约(1991年文本)。This paper summarizes the progress made in protecting and developing agricultural and forestry plant new varieties from the aspects of establishing laws and regulations for plant breeder’s right,constructing the protection system of plant new variety,expending protection category and developing test guideline.This paper points out the existing problems such as dim protection consciousness for plant new variety,uneven application numbers and unbalanced genus distribution,serious false tort and hardship in safeguarding legal rights.The paper also puts forward that the efficient harmony among legislation,administrative protection and justice administration should be strengthened to make protection of plant new varieties suit the international tendency,and the UPOV（1991 act） treaty should be joined in proper time.
