摘　　要：文章通过对两个医疗纠纷诉讼案件生效判例的分析,例举医疗纠纷诉讼中三个常见问题,即案由二元化、法律适用二元化以及举证倒置对纠纷处理的负面影响,并通过比较而探讨《侵权责任法》对医疗纠纷诉讼规则的影响。This text to begin with the analysis of two medical malpractice lawsuits cases examples out of three frequently asked questions in medical malpractice lawsuits, which are cause of action dualism application of the law dualism and the negative impact what the burden of proof in reverse lead to.
