摘　　要：党的十七届三中全会通过的《中共中央关于推进农村改革发展若干重大问题的决定》,为加强农村土地承包经营权流转制度立法研究指明了方向。农村土地承包经营权流转的立法目的和任务是为了规范农村土地承包经营权流转行为,维护流转双方当事人合法权益,促进农村经济和农村社会的稳定发展。农地承包户应当是土地承包经营权流转的出让方,股份合作、土地信托、土地银行等将成为新型流转方式。确立和完善农村土地承包经营权流转程序、登记制度以及服务监管制度,无疑对确定流转法律关系,减少流转交易纠纷,提高流转效率,维护农村土地承包经营权流转的良好秩序具有重要意义。The Decision of the Central Committee of the Communist Party of China on Several Big Issues on Promoting the Reform and Development of Rural Areas passed at the third plenary session of the 17th central committee of the communist party of China is instructive for the legislation researches on the transfer system of rural land contract management rights.Its purpose is to set rules for the transfer behavior of the rural land management rights and protect the rights of the participants so as to assure the stable development of the rural society and economy.Agricultural land contracted households should be the transfer of the transferring.Joint-stock cooperative,land trusts,land banks will become the new types of transferring patterns.To establish and improve the rural land contract management rights transfer procedures,the registration system and the regulatory system undoubtedly have great significance to reduce the transferring disputes,improve transferring efficiency,and to maintain the good order of the rural land contracting and management transformation.
