摘　　要：我国的法律法规和政府文件明确了消防部队承担公共危机管理综合应急救援的职能,但消防部队作为应急救援主体力量的法律地位不明确。分析了消防部队应急救援职能和法律地位的现状,探讨了确立消防部队为主体地位的必要性和可能性。消防部队作为应急救援的主体地位需要统一制定专门法律,明确规定其主体地位、权力、权利和义务,以及与政府和其他救援力量的法律关系及应赋予的法律责任。The law and regulations and government documents have announced that the fire-fighting force should give rescue to the public crisis,but it＇s unclear for fire-fighting force to be the main emergency rescue force.The emergency rescue function and the present legal position of fire-fighting force were analyzed and the feasibility and necessity for fire-fighting force to make sure the dominant position were discussed.Legislate to stipulate the dominant position,power,right and obligation of fire-fighting force,and also to stipulate the legal relation to the other rescue force and legal responsibility of fire-fighting,is needed.
