论查办案件的治本功能与合理定位

摘　　要：查办案件既具有惩戒、震慑等治标功能,同时又具有促进教育、制度、监督等治本功能。与源头治本相比,无论是在覆盖广度、时间跨度上,还是在工作力度、群众参与度上,查办案件的治本功能都有其自身的局限性。必须合理定位查办案件的治本功能,把办案治本与源头治本有机结合起来,形成反腐倡廉建设的强大合力,才能不断铲除腐败现象滋生蔓延的土壤,取得反腐倡廉建设新的成效。Investigating and Settling Case not only have a function to punish and threaten criminal,but also have the function to educate people and control the possibility of criminal.Comparing the avoidance of criminal in the origin,the function of the Case investigation and Settlement in avoidance is a potential force,which have some limitations in the extent of space and time,in the strength and the participation of people.Therefore,to integrate all forces in anti-corruption,to delete the base of corruption and to obtain the great success in anti-corruption,we must combine both of case settlement and origin avoidance together.
