消防责任事故罪客观要件辨析

摘　　要：在综述消防责任事故罪中的"经消防监督机构通知采取改正措施拒绝执行"要件观点的基础上,对该要件的存在基础、对主体范围的限制、放纵犯罪以及刑法的预防功能等方面进行了分析,指出该要件的缺陷,进而提出合理化建议。Based on the summaries of the conditions of ＂rejection to carry out the rectification measures even after receiving the notice form fire supervision department＂ in the liability of fire accident crime,this paper points out the defects of current basis of the conditions for defining the liability of fire accident crime,the limits to the main body,the crime indulgence and preventive function of the criminal law,and then offers some suggestions.
