论体育赌博的法律规制与基本对策

摘　　要：体育赌博具有深刻的社会、行业背景及复杂的特点,有效防治是困扰全球的难题。境外对体育赌博的刑事政策有完全合法化、有限合法化和非法化三种,在立法与实践中制定专门的反赌博法律和体育犯罪罪名,建立协调机制多措并举等。我国已初步建立起行业自律、行政法规和刑事法律的反体育赌博法律体系,加大了法律规制力度,还应采取以下基本对策:深化体育改制转变管理运作模式,强化网络、金融和电信等部门监管职能,加强跨国境与全球化协作,着力发展体育彩票事业和加大宣传教育力度。Sports gambling crime is one of specific gambling crimes,with its intention of gaining and losing property as the result of sporting events,and has deep background of social transformation and sports reform,so the effective prevention of which is a global issue.The criminal policy to sports gambling overseas have three styles:completely legal,limited legal and illegal,take measures of specialized anti-gambling laws and criminal charges legislation,of coordination mechanism establishment.China has initially established against sports gambling legal system including industry self-regulation,administrative regulations and criminal laws,but should also take the following basic measures:speeding up the sport reformation,contacting closely with the network,financial and telecommunications sectors,strengthening cross-border and global collaboration,developing sports lottery business and increasing public education.
