我国见义勇为立法问题探析——以美国法的比较和借鉴为基础

摘　　要：比较中美两国对"好撒马利亚人"立法的历史、发展及现状,可以看到我国对见义勇为进行立法保护和救济的迫切性。尤其在赋予见义勇为者有限的豁免权、加强对见义勇为者的权益保护及如何救济方面,我国需要进行明确立法,避免"英雄流血又流泪"事件的发生。The students from Yangtze University saved the children from drowning at the cost of their own lives in October 2009,which made the legislators take deep consideration into the necessity to give assistance to strangers beyond special relationships.Compare with the legislation of American,including the history,the development and the current situation of ＂Good Samaritan＂ laws,we should realize that it is an urgency to protect and compensate the ＂Good Samaritans＂.We should make laws,particularly in providing limited immunity if a person chooses to help,strengthening the protection of person who helps the strangers,and void the occurrence that the hero is tearing when bleeding.
