摘　　要：近年来大量出现的基金"老鼠仓"现象,激化了投资者对相关利益链条和监管部门的不满和矛盾,严重打击了市场信心,对资本市场产生了巨大的危害。文章从"老鼠仓"的技术特征、形成原因、主要行为方式及在法律认定中的问题和完善相关立法对于打击"老鼠仓"犯罪的现实意义角度,对该现象进行了剖析,以期推动司法机关打击该类犯罪观念的更新和立法的进一步完善。In recent years large numbers of funds ＂Rat＂ phenomenon intensified the discontent and conflict of investors to the parts in the chain and the relevant regulatory authorities,severely blowed the confidence of the market,had a great harm on the capital market. This article analyzes the phenomenon from the ＂Rat＂ behaviors’ technical characteristics,causes,mainly behaviors and legal problems of identification and the practical meaning of relevant legislation for combating ＂Rat,＂ which hopes to promote the renewal of the ideas of combating the crime by judicial organization and the further improvement of legislation.
