摘　　要：在法律全球化过程中,美国法大规模输往拉美国家,占领了全球新商人法,猎食了苏联和东欧等转型国家的法律改革,并对欧盟及其成员国的法律制度和法律文化发起攻势。这些典型例证表明,美国法出现了全球化的趋势。这种趋势的形成具有复杂的背景和动因。结合这种趋势,从法理学和比较法的角度反思法律与发展运动,审视法律现代化理论,拓展法律移植研究,并关注当代世界法系格局的新变化,不仅具有重大理论价值,而且具有重要实践意义。In the process of globalization of law,American law has been imported intO many Latin American countries on a large scale.The global field of lex Merca toria has been occupied by American law.The legal reform and reconstruction of the post Soviet Union and eastern European countries has been hunted by transplanting of American law.The recent development of law of EU and its member states has been heavily influenced by American law.These typical exemplifications show a general tendency of globalization of American law.The tendency originated from complicated causes and background.It is very significant theoretically and practically,be based upon the description of the tendency,to reconsider the moment of law and development, the theory of modernization of law,the proposition of legal transplants,and the new trend of changing of major legal systems in the world today from the perspectives ofjurisprudence and comparative law.
