摘　　要：近年来,由特殊关系引发的不作为侵权案件不断涌现,给我国侵权行为法提出了新的课题。经过司法实践的长期总结,特殊关系的类型多样,但主要是"学校、教师与学生之间的特殊关系"、"专门职业人员与契约相对人、第三人之间的特殊关系"、"恋人之间的特殊关系"等。特殊关系理论在分析过程中体现的不足和缺陷,需要各国理论和司法实践的不断深入和更新。In the recent years, negative tort cases caused by special relation have emerged constantly, which is a new subject of Law of Tort. There are many kinds of special relation such as mainly ＂the relation of school, teachers and students＂, ＂professional staff and contract relatives and the third person＂, ＂the relation of lovers＂. The shortcoming and defects in the theory of special relation should be updated further by the theoretical and practical field in every country.
