摘　　要：我国的地方法制问题是一个颇具本国特色的问题。对地方法制概念的界定,需要把握概念边际的确定原则。地方法制是法治国家建设的重要组成部分,它决定并制约着国家法治化的进程。我国地方法制的研究范围包括地方国家政权机构的组成与职能分配的制度化问题、国家机构实施法律的方法与具体制度和权利实现的民间保障机制。强调指出研究地方法制,就是要把人作为法治建设的根本。国家制度越是健全,规则体系越是完善,群众参与制度建设的能力越强,国家就越是以人为本,越是把人当做人。所以,与群众最为接近的地方与基层的法制实践,才是法治国家建设的真正舞台。The author points out that in our country,the improvement of the ＂country under the rule of law＂strategy is determined and restricted by the level of the local legal system＇s construction.The issues in the local legal system are not relating to the local regulations and its administration,which is enacted by local governments at all levels employing the right of creating normative legal documents that ruled by the Legislation Law of PRC,but mainly about the implementation of national law,and the active promotion that the local performed on the legal development.The local and the lower governments are the most vigorous power in the practice of law in China.This article discussed the five following problems respectively： the particularity of our local legal construction,the concept of local legal system,the significance,scope and theoretical basis for concerning researches.Meanwhile,it also emphasized that while studying local legal system,the person should be laid as the foundation of the legal construction.The public＇s capacity of participating in the construction of the system will become stronger when the state＇s institution becomes better and our rule systems become more perfect.And this will enforce the country to put more efforts on humanism.Therefore,the legal system practice in the local and the lower governments,which are the closest place to the masses,is the real stage of the construction of the ＂country under the rule of law＂.
