网络参与的意义与局限——政府决策的视域

摘　　要：中国的网络舆论正在蓬勃兴起,甚至在一定程度上主导了公众舆论的方向。网民通过微博、网络建言、博客评说、在线交流、征集意见、网络投票、网上提案等形式积极参与到政府决策,出现这个局面是自上而下与自下而上双向努力的结果。网络参与促进了我国社会转型期行政决策的正当性,制约了行政决策权力的恣肆,维护了公众利益。网络参与有简单化和浅层次的问题,也有代表性不足的缺陷,但是对网络舆论及参与的传统规制方式有遏制参与自由之虞。从技术角度,还是从政治角度,对网络参与都应提供一个宽松、宽容的制度环境,鼓励更多的社会成员通过网络参与到公共事务中来,从而优化治理水平。The public opinion on internet rises vigorously in China nowadays,and always leads to a consensus.The netizens actively participate in government＇s decision-making through BBS,blogger,online communication,internet voting,internet proposal and mayor＇s mailbox etc,which is the result of top-down and bottom-up efforts.Internet participation improves the legitimacy of administrative decision-making in transitional period,thus,to a certain content,restricts administrative power and safeguards public interests.Despite of being simplistic,superficial,and less representative,the internet participation makes up for lack of public participation in reality in China.Therefore,both in technical point of view or political point of view,a relaxed,tolerant system should be provided,and citizen participation in public affairs through internet should be encouraged,thus optimizes the governance,and promotes democracy and the rule of law in China.
