国外劳务派遣公司设立制度对我国劳务派遣的启示

摘　　要：指出了劳务派遣公司设立在国外有较为完善的立法,我国可以对此进行批判式借鉴。主要集中在设立人、设立资本、经营范围和许可制度方面。提出了具体做法即拓展设立人范围,允许法人和国家的介入;实现资本来源的多样性,放弃原来的保证金制度;采用反向列举的方式规制经营范围并解决专营化问题;设立一套具体的设立许可制度,以此完善我国的设立制度。The establishment of labor dispatching company in foreign countries has a relatively perfect legislation.It can provide a critical reference for our country.These references are mainly on the following fields： initiator,establishing captial,business scope and licensing.Their specific methods are as follows：expanding the scope of initiators,which allow legal persons and state intervention;realizing the diversity of capital sources;abandoning the deposit system;using reverse enmuerated way to regulate scope of business;setting up a set of specific establishment permit system to perfect our establishment system.
