摘 要:学界对行政程序的关注主要限于"法定行政程序",而对"非法定行政程序"有所忽略。"非法定行政程序"为法律、法规、规章规定之外的行政程序,它虽具有弥补法定程序不足的功用,但也容易滥用因程序裁量权而忽视相对人的程序性权利。对于不违反法律、法规、规章的非法定行政程序,法院应当按照"正当程序原则"的司法审查标准进行审查;违反该原则的,属于《行政诉讼法》第54条规定的"滥用职权"之情形,法院可据此撤销相应的具体行政行为。At present,when we study and discuss administrative process,we mainly concern "legal administrative process" and neglect "illegal administrative process".Illegal administrative process is not stipulated by laws and regulations of State Council and reguations of local governments.Illegal administrative process comes from administrative convention or is stipulated by administrative document.Illegal administrative process can supplement the defects of legal administrative process,but it often neglects the rights of parties in process.When illegal administrative process do not violate legal administrative process,the courts should review it by "due process principle".When illegal administrative process violates "due process principle",the courts may annul the specific administrative act by the legal grounds of "misfeasance" in the Administrative Litigation Law in 1989.
