中哈区域经济合作争端解决机制的分阶段设计

摘　　要：成熟的争端解决机制是区域经济合作得以健康发展的有力保障。鉴于中哈两国现行的争端解决机制存在纠纷解决方式少、纠纷解决条款覆盖面窄、解决机制设计简单等缺陷,本文提出两国应根据区域经济合作发展的不同阶段,分别针对中哈霍尔果斯国际边境合作中心、边境自由贸易区直至中哈自由贸易区设置相应的争端解决机制,以促进中哈区域经济合作的发展。A mature dispute settlement mechanism will guarantee the healthy development of regional economic co-operation.In response to the faultiness of the current dispute settlement mechanism of Sino-Kazakhstan regional economic cooperation,this essay suggests that the two countries should set up the dispute settlement mechanism in line with the different stage of Sino-Kazakhstan regional economic cooperation,namely the dispute settlement mechanism respectively for Khorgos International Border Cooperation Center,Border Free Trade Zone and Sino-Kazakhstan,so as to facilitate the development of Sino-Kazakhstan regional economic cooperation.
