摘　　要：对行政行为的研究历来是学者们关注的热点问题,其中不乏对行政不当行为之探讨,但大多没有对此进行深入或系统的研究,对不当行为的认识也不一致,还存在着很多误区。深入研究行政不当行为对于行政责任的认定等都具有重要意义。基于此目的而对行政不当的概念、特征以及效力作了分析与探讨,以期使理论界和实务界对此有一个明确的认识。The conduct of research has always been the concern of the hot issues,including the misconduct in administration,but mostly for this in-depth research,or system of misconduct does not accord with the knowledge,there are many major traps.Conduct in-depth studies on the administrative responsibility of all that is significant,and for the purpose of the chief of the concept and characteristics and work for analysis and study with a view to making theory circle and practice about this is a clear understanding.
