浅谈构建我国的海洋生态损害责任保险制度

摘　　要：我国立法方面尚没有专门规定环境责任保险的法律,只是在一些部门法和政策性文件中有若干原则性规定。就建立环境责任保险的规定,比较集中在海洋领域的法律和条例中,加之海洋的特殊性,当前在海洋领域试行建立生态损害责任保险是现实可行的。构建海洋生态损害责任保险制度是保护海洋生态以及确保赔付实现的重要环节。海洋生态损害责任保险,适用于在中华人民共和国沿海陆域、管辖海域从事海洋开发和利用活动,或者可能引发突发性海洋环境污染事故,从而导致海洋生物物种、种群、群落、生境及生态食物链的损失,海洋环境功能损失和海洋生态服务功能减弱的各种行为。China has not yet made a specific legislation on environment liability insurance.Only a few stipulations are found in some divisional laws and other policy-type documents.Due to the particularity of ocean and the laws and provisions being concentrated in the marine field,it is now feasible to establish ecological damage liability insurance system in the marine field.Construction of marine ecological damage liability insurance system is crucial in ensuring payment of indemnity and protecting marine ecosystem.Marine ecological damage liability insurance should be applicable to all activities associated with marine development and utilization along the coastal land and in waters under the jurisdiction of the People＇s Republic of China,which possibly may result in unforeseeable accidents,destruction of marine biological species,population,community,habitats,and ecological food chain with loss of marine environmental functions and weakening of marine ecological service functions.
