摘　　要：从西藏农业遗传资源的状况出发,研究了相关国际公约和国内对农业遗传资源方面的法律法规及其存在的缺陷,特别是西藏的法律体系的缺陷,分析了用现有知识产权体系特别是专利制度保护农业遗传资源存在的弊端,并提出了用专门的农业遗传资源法律进行保护。Starting from the status of Tibet agriculture genetic resources,the related international convention and the domestic laws and regulations were studied as well as the existing defects.The disadvantages of the current intellectual property system especially for patent system protecting agriculture genetic resources were analyzed,the protection with special agriculture genetic resources law was put forward.
