摘 要:中国南海断续线是在1933年法国占领南沙九小岛、二战后法国继续占领西沙群岛,以及菲律宾企图把南沙群岛并入其国防范围内的背景下产生的,其目的是,向世界公布中国在南海的管辖范围,维护中国在南海的领土主权。在1951年《旧金山对日和约》草案中,美英故意不提西沙群岛和南沙群岛的主权归还问题,为以后的南海领土争端埋下了祸根。在这种情况下,南海断续线起到了一定的效用,它不仅反映了南海诸岛是在中国领土范围内的历史事实,而且是对《旧金山对日和约》领土处理的否定。The Chinese U-shaped Line in the South China Sea was created under the following background: France seized nine islets in the Spratlys Islands in 1933;after World War II,France kept on occupying the Paracels Islands and the Philippines attempted to incorporate the Spratlys Islands into its national defense scope.The aim of this line is to safeguard China's territorial sovereignty in the South China Sea and to proclaim its jurisdiction.In the draft of the San Francisco Peace Treaty with Japan signed in 1951,the U.S.and U.K.did not mention the return of sovereignty of the Paracels Islands and Spratlys Islands deliberately,thus laying the seeds of the South China Sea territorial disputes later on.In this circumstance,the Chinese U-shaped Line has played certain roles.Not only does it reflect the historical fact that the archipelagos in the South China Sea are within Chinese territory,but also denies the territorial disposition of the San Francisco Peace Treaty with Japan.
