摘　　要：基于历史唯物主义视角,分析知识产权的发展动力及其在不同时期对科技进步的作用,科学评价知识产权的正当性。人们对科学技术商品化所带来的物质利益的追求是知识产权诞生的直接动力,科技的发展推动着知识产权不断扩张。科学技术的经济价值使科技日渐异化为资本增值的工具,作为资本控制技术的重要手段之一的知识产权开始走向自己的反面,阻碍了科学技术的发展,"旧知识产权"时代难以避免衰退的命运。人类对科技自由的追求将开启"新知识产权"时代。It is the premise to evaluate the legitimacy of intellectual property that review the development of intellectual property in historical perspective and analyze the role that IP plays in technological progress at different times.Peoples pursuit of material interests in the commercialization of science and technology brought about intellectual property.The development of Science Technology promoted the expansion of intellectual property.Science and technology has been alienating for capital appreciation,one important means of technology control by capital is intellectual property,which has hindered the development of science and technology,the ＂old IP＂ times Declines.The pursuit of human freedom in science and technology will open the ＂new intellectual property times.
