摘　　要：中国非刑罚化的困境在于观念和实践中各种理念的相互冲击。重刑思想与轻刑思想的平衡,法治国理念对现实的要求,立法、司法和行刑环节中对法律品性的追求;而对其不断的反思也是实现中国刑法文明的有效路径。The difficulty of depenalization lies in the mutual impact of idea and practice . The balance of heavy penalty ideas and light ones, the reguest of legal state idea to reality, the pursuing of legal moral in the process of legislation, judicature, execution. Then realizing effective way of Chinese criminal law civilization through its unceasing reconsideration.
