摘　　要：通过对当前解决医疗纠纷途径困境的分析,介绍浙江宁波、温州引入中立第三方调解机制解决医疗纠纷的实践,明确"第三方"机构设置在司法行政部门、引入医疗保险理赔机制,明确"第三方"介入运作机制,对"四方合作"共同处置医疗纠纷、打击"医闹"有明确规定。指出其对维护医疗卫生工作秩序的积极意义,并进一步思考其损害患方利益的可能性,以期不断完善和改进医疗纠纷处置的实践和探索,更有效解决医疗纠纷。This paper analyzes the current problems in medical disputes handling, and introduces the experience of medical dispute mediation in hospitals in Ningbo and Wenzhou, in order to perfect the handling of medical disputes and help maintaining a regular medical order. Some concrete suggestions are also raised, including clarif- ying the establishment of third -party mediating mechanism in judicial and administrative department, introducing claim management of medical insurance, defining the intervening mechanism of third - party mediation, formulating the four - party cooperation in handling medical disputes, and make concrete regulations for coping with medical riots.
