网络自由不能承受之忧——从3Q大战看网络用户民事权益的保护

摘　　要：3Q大战使网络用户的民事权益再次被凸显热议,具体涉及免费软件产品上的信息财产权益、网络服务中的消费者权益、隐私与个人信息等人格权益、网络格式合同权益等问题。要加强和完善网络用户民事权益的保护,应着重注意:新增和完善相关立法,为网络用户提供权利基础和法律依据;强化司法规制、加强执法力度,为网络用户权益提供事后保障;增加网络信息法的课题投入与理论研究,为制度建设争取学术支持;加强信息法制宣传、培养网络法律意识,实现网络用户的自我防护;发挥行政政策的灵活功能,及时实施监督管理;培育网络伦理规范、完善社会监督机制,运用社会力量综合治理。The civil rights and interests of web-users has become the point at issue in the war between 360 and Tencent again,which mainly involves the information property on free software products,consumers＇ rights in web service,private information and contract rights in web form.In order to enhance and perfect the protection of the civil rights and interests of web-users,the followings are very important.To provide legal proof for web users,we should improve relevant laws and strengthen judicial safeguard and enforcement,increase input and research on web and information law to gain academic support,cultivate law consciousness of inter-network to protect web users themselves.We could realize comprehensive tackling of society by constructing moral rule in inter-network and improving social supervision.
