天坑现象与制度迷失——对城市地下空间开发利用中的环境评价标准问题的思考

摘　　要：当前,我国城市地下空间开发利用正风生水起。然而,在城市地下空间开发过程中对环境评估的重视却十分不够,且我国当前城市地下空间开发利用的环境评价体系是缺失的,其主要原因在于城市地下空间开发利用环境评价标准的缺失。国家层面我国现行城市地下空间开发利用中环境评价标准缺失,地方立法活跃。当前,应当确立城市地下空间开发利用中环境评价标准,明确城市地下空间开发利用中环境评价标准的制定基调环境评价标准,以便于事前预测评估、事中监督和事后评估,实现地下空间开发中环境评价标准与环境评价制度的有效衔接。China＇s rapid economic development makes the wind and water development and utilization of urban underground space.However,during the development of underground space in the community not pay enough attention to the environmental assessment,China＇s current urban underground space development and utilization of the lack of environmental assessment system,national level,the current utilization of urban underground space development standards related to specific legal absence of environmental assessment,although local developed a number of regulations,standards are not involved.Present,the legislative branch should be developed in the urban underground space development and utilization of environmental assessment standards,easy to predict the assessment,monitoring and post-assessment in the matter.Underground space development in order to achieve the environmental evaluation criteria and evaluation system of the effective convergence environment.
