摘　　要：事实自证是英美法系中的最具争议性的专业词汇,对于它的法律效果,观点分歧较大。本文通过分析事实自证的起源和现状,探寻关于事实自证法律效果的规律性认识,期冀厘清关于事实自证法律效果各种观点的内部联系,以对国内的侵权法研究有所裨益。Res ipsa loquitur is a technical term most controversial in the Anglo-American law system as there exist many diverse opinions of its legal effect. This article makes an analysis of res ipsa loquitur in terms of the origin and the actualities, and explores understanding of regular patterns of the legal effect ofres ipsa loquitur, aiming to make clear the internal relations of different views on res ipsa loquitur. The exploration is helpful to the research on domestic tort liability law.
