公务法人视角下的高校图书馆还书逾期的法律分析

摘　　要：对图书馆图书逾期处罚的定性一直存在争议,而适时地引入公务法人制度,对高校图书馆及其处罚行为进行重新界定,则能充分解释图书馆逾期处罚这一问题。作为公务法人的高校图书馆,法律法规对处罚权予以授权或者改变处罚方式则可以对此问题予以解决。There is a debate about fines for overdue books in university libraries. It is proper to intro duce the concept of public legal person to explain penalty actions according to a redefinition of the relation ship between the library and readers. There are two suggestions;power of penalty should have been au thorized by law and regulations and its ways should also be changed.
