法治化背景下的乡镇治理研究述评与思考

摘　　要：在民主政治与法治建设不断发展的宏观背景下,学者们对乡镇治理问题展开了深入研究,这些研究可以概括为:系统梳理乡镇治理的历史脉络,集中分析乡镇治理存在的问题,多角度探讨乡镇治理转型可能的实现路径。这些研究从理论上推动了基层政府治理转型,为进一步的民主实践提供了良好的理论基础,但也存在若干不足。在今后的研究中,一是要加强对治理理论的基础研究;二是要加强治理中的公民参与研究,通过从理论上构建公民参与机制,推动政府从人治转向法治,从管制转向服务,最终实现"善治"。With the macroscopic background of the democratic politics and legal construction,scholars＇ research on town governance can be summarized as： to analyze the history of town governance,to focus on rural governance problems and discuss the path of current town governance reform.These studies have promoted the transformation of town governance,and provide a theoretical construction to further political practices,but the studies are also insufficient.In the future research,firstly,we should strengthen the basic research of governance theory;secondly,we should strengthen the research of citizen participation.On the basic theory of the governance,we perfect the governance practices,promote rural government from regulation to service and ultimately realize the good governance.
