水库移民应然权利探讨

摘　　要：根据水库移民的身份属性和水库工程对移民可能造成的负面影响,对照国际人权宪章并结合我国人权现状,对水库移民的应然权利作了初步梳理分析,认为当前水库移民的应然权利主要应有生存权、发展权、财产权、知情权、参与权、环境权、信访权和救济权,以及由这些权利派生的二级权利构成,旨在为我国水库移民权利保障相关政策的制定和立法工作提供参考。According to the identity attributes of reservoir resettlement and the possible negative impacts of reservoir projects, the idealistic rights of reservoir resettlement were investigated based on the international human rights charter and the current situation of human rights in China. The idealistic rights of reservoir resettlement should include the survival rights, development rights, property rights, learning-the-truth rights, participation rights, supervision rights, environment rights, visiting rights and relief rights as well as the secondary rights derived from the above rights. It would provide some useful information for the preparation of policies and legislations related to the protection work of the resettlement rights.
