高校图书馆随书光盘管理系统运行中的著作权问题探析

摘　　要：随书光盘的充分利用是图书馆开展特色信息服务面临的重要问题,购买或自建随书光盘管理系统是当前许多图书馆的做法。无论从内容或形式来看,随书光盘都受到著作权法保护,随书光盘管理系统运行中遇到的著作权问题主要是复制权和信息网络传播权问题,在现行著作权法律框架下规避版权风险应充分运用"合理使用"原则、购买合法出版物、坚持公益性和非赢利性、保证光盘完整以及努力做好技术防范。The full use of the CD attached with books is the important issue for the libraries in developing characteristic information service.The prevailing practice is purchasing or self-building of the management system.In view of the fact that the copyright of the CD attached with books is protected by the copyright law,the management system faces the copyright problems,mainly the right of reproduction and the information network transmission right.So to avoid risk of copyright in the current copyright legislation framework,the following rules are to be followed：＂rational use＂principle,purchasing of legitimate publications,adhering to the public welfare and non-profit principle,assuring the intactness of CD and finally,managing of the technical prevention.
