完善我国产品责任法律制度的思考

摘　　要：针对我国产品责任法律规定存在的某些不足,提出建议和对策,如制定独立的作为民法特别法的产品责任法;明确产品的含义,合理界定产品的范围;完善产品缺陷的认定标准及范围;进一步明确产品责任的责任主体;明确销售者承担责任的归责原则;完善产品责任的抗辩事由(免责条件);完善产品责任的损害赔偿制度;以不断完善我国产品责任法律制度,更好地维护广大消费者合法权益。In view of the product liability law for certain deficiencies, make recommendations and response, such as the development of an independent special law as a civil law of product liability law; clear the meaning of products, reasonable definition of the range of products; improve product standards and scope of the defects identified ; further define the main responsibilities of product liability; clear attribution of responsibility seller principle; improve the product liability defense reasons （exception condition）; perfect system of product liability damages; to constantly improve our product liability legal system, better to safeguard the legitimate rights and interests of consumers.
