摘　　要：从1948年《哈瓦纳宪章》到WTO的TRIMS,国际投资法制经历了从多边投资条约的失败到双边与区域性投资协定繁盛这样一个发展过程,但是国际投资法制多边化进程从来也没有停止过。晚近国际投资法制一致性发展的需要、投资者与国家及国际组织的努力推进,使得国际投资多边法制建设产生了可能性也具有可行性。未来多边投资条约中的重要问题如平台建设、争端解决机制、既有条约与未来多边投资条约的关系如果得到有效地解决,多边投资条约的产生指日可待。Historically,multilateralism of investment treaties has been failed,such as the Havana Charter of 1948,MAI of OECD,TRIMS of WTO.Contrarily,BIT and RTA are in the boom way.But we can still find that the trends to the multilateralism of international investment law.The need for practical and structural and coherence is impelling the investment treaty towards the multilateralism.But we need to solve some key issues concerning the future multilateral investment treaty,such as what kind of international organization,dispute settlement mechanism and the relationship between existed investment treaties and the future multilateral investment treaty.If we can solve these problems,multilateral investment treaty can be realized in the near future.
