别居制度在我国婚姻家庭法中的导入——浅议我国目前婚姻家庭状况

摘　　要：别居制度是外国亲属法中的一项重要制度,符合婚姻的本质和婚姻自由原则;我国婚姻家庭法中没有对其规定。一方面,目前我国婚姻家庭状况不容乐观,婚姻的不稳定性加剧,离婚率不断上升,迫切需要别居制度的建立;另一方面,司法审判实践中,基层法院面对纷繁复杂的离婚诉讼已探索和尝试了相关的审判方式,急需立法以别居制度的方式加以明确下来。我国婚姻法构建别居制度要考虑我国婚姻家庭的特点,又要与现行婚姻法相衔接。Separation system is an important system in law of domestic relations in foreign countries, which conforms to marital essence and freedom of marriage doctrine. However, it isn＇ t formulated in our mar- riage and family law. On one hand, nowadays, our situation of marriage and family is not optimistic; the sta- bility of marriage aggravated, divorce rate is rising, separation system needs to be established imminently; On the other hand, in practice of criminal justice, primary court has explored and tried related way of trail in the face of complex divorce proceeding, so that legislation is needed urgently in the manner of separation system. To construct separation system in our marriage law, we need to consider the specific status of our marriage and family and the existing marriage law.
