涉法涉诉信访问题的成因与对策初探

摘　　要：中国处在社会转型期是涉法涉诉信访问题高发的根本原因;而现行信访制度的不完善则是直接原因;司法权威缺失,历史文化传统、法律信仰和法律意识的缺失以及政府公信力下降是涉法涉诉信访案件高发的外因。应强化信访职能,整合信访资源,构建和完善涉法涉诉信访的各项制度,如党政领导信访负责制、涉法涉诉信访监督机制、诉访分离制以及信息沟通、交流和反馈机制等,以较好地解决涉法涉诉信访问题。China is in the period of social transition, which is the root of the high frequency of letters and visits involving laws and litigation. And the present imperfect institutions are the direct reasons and the lack of judicial authority, the historical and cultural tradition, the absence of legal faith and awareness and the declining of the Government credibility are the external causes. Therefore the functions of the organs of letters and calls should be strengthened, the resources of letters and calls should be integrated, the instituions of letters and visits involving laws and litigation should be constructed and improved in such aspects as the responsible system of the Party and government leaders, the mechanism of monitoring letters and visits involving laws and litigation, the separation system between litigation and visits, information communication, exchange and feedback mechanismsand so on.
