摘　　要：患者的知情同意权是患者的基本权利,同时医生决定权也是医生在临床医疗救护时享有的正当权利。当患者自己的决定与医疗机构的治疗决定产生冲突时,势必会对患者的治疗产生不良影响,如何调节二者的冲突对于建立和谐的医患关系具有重要意义。本文探讨了患者的知情同意权及其局限性,医生治疗决定权及其局限性和患者知情同意权与医生治疗决定权冲突的解决等问题。The informed consent right is a basic right of patients,while medical decision right also is a basic right of doctor.If the conflict arising between patient＇s own decision and doctor＇s decision right,adverse effect in treatment will be occurred.It is important to smooth this conflict for building harmonious hospital patient relationship.Conception and its limitation on informed consent right and medical decision right are discussed and countermeasures of resolution the conflict are mentioned.
