摘　　要：国际法中的战争法的基本原则有;限制原则;比例原则;区别原则;"军事必要"不解除当事国义务的原则;条约无规定的情况不解除当事国义务的原则。国际法对战争的约束面临新的挑战。各国家对国际法的自觉遵守是对国际法约束力的挑战之一。新型战争武器的使用脱离了法律的约束。军事技术的发展使得人道主义弱化,战争灾难加剧。The principle of war law of international laws includes： constraining one;rate one;distinction one;the principle which the duty of war country is not dissolved because of ＂military necessity;the principle which the duty of war country is not dissolved because of no regulation pact.The constraint of international law to the war faces new challenges.That each country is conscious to obey international laws is a challenge of the constraining power of international laws.Using new type war weapons get rid of law constraining.The development of military skill make humanism weaken and war disasters become heavier.
