摘 要:历史而言,维稳是一个老问题。当下维稳出现了某些新元素,但总体而言,依然是一种体制化维稳。权力配置资源,以资源补偿为维稳方式,是一种应急型、事后型、运动型的维稳。通过对当下维稳的成因与效果分析,可以发现当下维稳体制以人治为构建方式,长久运行将消解法治。而通过对维稳法律依据的分析,可以发现当下维稳过分重视政府作用,忽视公众在维稳中的主体作用,同样不利于民主和法治的构建。为此,要矫正"越维越不稳"的怪圈与困境,必须扩大维稳的公众参与,既实现公众权利,又有利民主的实现,如此方能真正稳定。Historically, the requirements of holding stability is an old problem. Although the current holding stability has some new elements, it still follows the old road system of maintenance of stability: that is powerdriven resource allocation, resource compensation method for the maintenance of stability, which is an emergency type, after-type and athletic holding stability. Through analysis of the causes and effects of current maintenance of stability, it can be found immediately that the current holding stability is built by the rule of man, whose long-term operation will be a digestion of the rule of law. Analyzing the legal basis of it shows the current holding stability pays too much attention to the role of government, ignoring the main role of the public in the current holding stability. It is not conducive to the rule of law and democracy building.
